What is a Federal Motion Hearing?

Federal criminal defense attorney Ryan Pacyga explains what a Federal Motions hearing is about. There are 2 main categories of federal motions: discovery (the evidence) and suppression (throwing evidence or charges out). A good federal criminal defense attorney will ask for extra discovery and for it to be turned over earlier than the rules require. A good federal criminal defense attorney can find potential constitutional violations and ask for the evidence or charges to be thrown out. After a motions hearing, the magistrate will make a ruling, and that can be reviewed by the Judge. The case usually keeps going towards either trial or settlement after the motions hearing.
